Default Retail Statutory Rights Question

Does anyone know anything about your statutory rights when buying from a retail shop?

I bought 3 pairs of shorts, 2 of the same type and one a different brand. All 3 were the same size but for some reason the different brand wouldn’t fit, significantly different size.

So took them back to Sports Direct and asked for a refund, “no we don’t do refunds” “ok wheres your terms and conditions” they have a small notice on the counter which is usually covered up with everything that you are paying for.
Ended up with a credit note which the next person in the queue kindly bought from us. I’d really rather not give them my business in future but unfortunately they have a large selection of clothing and shoes at reasonable prices so I’ll be cutting my nose off to spite my face if I don’t go back.

Would love to know what our rights are because other shops accept things back for refunds.

As far as I am aware it can be a complicated issue, if something is not fit for purpose they have to refund you, if it is not the right size this is a grey area unless it is labeled incorrectly, which may or may not apply in your case, but to state "they do not give refunds" is against the law, Rick

Thumbs down Refunds

I agree with Rick it is complicated - many store such as M&S have limited refunds to a short time period - mainly due to fraud.

I never buy trousers or shirts without trying them on unless its an identical item I have purchased before. Its a pain but saves going back.

By contrast the wife never tries clothes on and we end up returning stuff with monotonous regularity - especially to the likes of Matalan!

As said before,

The shorts were fine, no issue.

Only issue was they don't fit, tbh you did well to get a credit note.

Yeah I’ve googled it and yes the store is correct though I do think the small notice on the counter that conveniently gets covered up each time a customer places their shopping on the counter. As for trying on that’s another story, they close the changing rooms on an evening.
Reckon if I had the enthusiasm to put a complaint together in writing I could of got somewhere but seen as the customer behind us gave us cash for the credit note I haven’t lost anything.

That is my experience of Sports Direct, no refunds so once they have your money the only option is goods to the value of or spend more money. I have returned one pair of trainers that were faulty and luckily they had a pair to exchange them with as the stock seems to change constantly.
